Indefinite Delay of Justice

This is old news, but I’ve been surprised the lack of talk about it in the blogosphere: The New York Times’ Charlie Savage reported Friday on the decision by the Obama administration’s detainee task force to continue to indefinitely imprison about 50 Guantanamo Bay detainees. These detainees will not receive a trial despite a 2008 Supreme Court decision that all Guantanamo Bay detainees have habeas corpus rights. The indefinite detention status will presumably continue even if the detainees are shipped next year from Cuba to a new federal supermax prison in Thomson, Illinois.

How is the Obama administration turning the page from the Bush administration’s “war on terror” here? And, most important, how can indefinite detention possibly withstand court challenge when even the conservative, John Roberts-lead Supreme Court ruled that these detainees have the right to challenge their imprisonment?
